By using this Site, the User agrees to these Terms of Use (“Terms”) in force at the time of use. This website and/or online travel platform is owned by PriceBreaker and Pacific Arena Pte. Ltd. (collectively referred to as “Pacific Arena”, “us”, “our” or “we”).

These Terms may be changed at any time and without prior notice. The User is therefore advised to consult the Terms at each visit to the Site.

1. Site Purpose

The purpose of this Site is to provide the User with public information about Pacific Arena and its products and services. When transacting business with Pacific Arena or using our technology, separate terms and conditions may apply.

2. Accuracy and Site Content

We use reasonable skill and care in compiling the information accessible on and through this site. However, certain information may have been compiled and/or provided to us by a third party. Pacific Arena does not accept responsibility for the accuracy of any information which is obtained from any such third party. Furthermore, errors and omissions in the information accessible on and through this site may occur due to factors inherent in any internet-related system and which are not within our reasonable control.

3. User Accounts

The User must provide us with information that is accurate and complete when creating an Account with us. It is the User’s responsibility to ensure that the information tagged to his/her Account is current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of the Account or our services.

The User is responsible for safeguarding the password used to access our Site, and for any activities or actions carried out under the User’s Account and password. The User agrees not to disclose his/her password to any third party and must notify us immediately upon becoming aware of any breach of security or unauthorised use of the Account.

We reserve the right to limit, suspend, deactivate or terminate an Account, without prior notice or liability under certain circumstances at our discretion, such circumstances shall include (but is not limited to):

  • Breaches or violations of the Terms or other incorporated documents, guidelines or rules;
  • Request by law enforcement or other government agencies;
  • Self-initiated account deletions;
  • Infringement of our intellectual property rights;
  • Discontinuance or material modification to our services, or part thereof; or
  • Unexpected technical or security issues or problems.

Any reinstatement of Account shall be at our sole discretion.

4. Traveller’s Details

It is the traveller’s sole responsibility to ensure that the name provided to us during booking is exactly as it appears on the traveller’s passport or travel document (i.e. correct spelling and order of name). Any correction to the misspelling of name is subject to change and/or cancellation penalties imposed by the Supplier.

Suppliers retain the right to refuse service obligation if the traveller’s name indicated in the booking fails to match that of which is stated on the traveller’s passport or travel document. Pacific Arena will not be held liable for circumstances due to such errors.

Further, travellers are obliged to check through their booking details at the point of booking. Any change(s) required, resulting from accidental errors may incur change fees imposed by the Supplier or a full cancellation should the said change not be feasible.

5. Supplier Rules and Restrictions

The User may access or book travel related services on our Site. We facilitate bookings with travel suppliers ("Suppliers") such as airlines, General Distribution Systems (GDS), hotels, property owners, cruise lines, rail providers, insurance providers, car rental providers, ground transportation providers, tour operators, online travel agencies, and intermediaries who will fulfil the User’s travel reservations. These Suppliers are independent contractors and not agents or employees of Pacific Arena. We are not responsible and have no liability to the User in respect of such bookings regardless of any unforeseen circumstances including but not limited to delays, cancellation, force majeure, strike, overbooking. Each Supplier may also have different policies regarding cancellation, modification and refunds for bookings and reservation. It is the User’s responsibility to read the full terms and conditions issued by the Supplier, which can be found on the Supplier’s website. The User agrees to abide by the terms and conditions of purchase imposed by any supplier with whom the User elects to deal with, including, but not limited to, payment of all amounts when due and compliance with the Supplier’s rules and restrictions regarding availability and use of fares, products, or services. We reserve the right to cancel a booking if full payment is not received in a timely fashion.

Some hotels and cruise lines may require the User to present a credit card or cash deposit upon check-in to cover additional expenses during the User’s stay. Such deposit is unrelated to any payment received by us or payable for the booking made.

6. Fares, Currency Conversion and Fees

Flights purchased on the Site is only confirmed upon successful payment receipt and ticket issuance to the User. Hotels purchased on the Site is only confirmed upon successful payment receipt and voucher issuance to the User.  

Selected prices may be quoted in foreign currencies (i.e. non-Singapore dollar). Our exchange rates are subject to daily currency fluctuations and processing fees. In calculating the amount payable Pacific Arena retains the right to round up nominal amounts for each line item to account for variances in the way we and our Suppliers handle currency conversions. The amount rounded-up will be to the nearest five Singapore cents.

If the Supplier’s terms and conditions allow for amendment or cancellation of a reservation, Pacific Arena reserves the right to charge an administrative fee on top of any existing amendment or cancellation fee charged by the Supplier.

If the Supplier’s terms and conditions allow for refund or travel credit on a cancelled reservation, Pacific Arena reserves the right to charge an administrative fee for facilitating the issuance of the refund or travel credit from the Supplier. Supporting documents are required for submitting an appeal. The appeal process requires a minimum turnaround time of two months from the first date of submission. In the event of a successful appeal, any refund amount will be credited to the original payment mode used for the said booking.

7. Payment

For payments taken at the time of booking, the Merchant of Record will be: (1) Pacific Arena Pte. Ltd., 200 Cantonment Road, #04-05 Southpoint, Singapore 089763, or (2) the Supplier directly.

Many bank and credit card companies charge their account holders a transaction fee when the card issuer and the merchant location (as defined by the card brand e.g. Visa, MasterCard, American Express) are in different countries. The currency exchange rate, if applicable, and any transaction fee are determined solely by the bank or other agency processing the transaction. These fees may be applied by the card issuer as a charge to the cardholders account. This means the amount listed on the User’s credit card statement may be a different figure than the figure shown on the billing summary page for a reservation booked on this Site. Questions relating to such fees or exchange rates applied should be directed to the User’s bank.

8. International Travel

The User is responsible for ensuring that his/her travel documents, such as passports and visas (transit, business, tourist, and otherwise), are in order and any other foreign entry requirements are met. We are not responsible and shall not be liable if the User is refused entry into any country. We strongly recommend that Users review travel prohibitions, warnings, announcements, and advisories issued by the relevant governments, embassies or consulates prior to booking travel to international destinations.

10. Limitation of Liability

No warranty to the User is provided concerning the following:

  • The absence of anomalies, errors and bugs liable to affect navigation on the Site or the implementation of any functionalities proposed on the Site, or even the use of software accessed on or through the Site.
  • The possibility of correcting anomalies, errors or bugs.
  • The absence of Site breakdowns or service interruptions.
  • The Site’s compatibility with specific materials or configurations.

Pacific Arena cannot be held responsible for failures due to third-party software, regardless of whether these are incorporated into the Site or provided via the Site.

Pacific Arena is not liable for any damage, direct or indirect, whether foreseeable or unforeseeable (including loss of profits or opportunities) linked to the provision and/or use or the total or partial failure to use the Site functionalities.

11. Hyperlinks to Third Party Sites

The User may access third-party sites through hyperlinks present on the Site. Pacific Arena cannot be held responsible for the content, privacy or security practices and policies of third-party sites. Should the User follow a link to a third-party site, we recommend that the User carefully review that site’s terms of use and privacy policies.

12. Intellectual Property

The Site and its original content, features and functionalities are and will remain the exclusive property of Pacific Arena, protected by copyright, trademark, and other laws in Singapore. Our trademarks and trade dress may not be used without the prior written consent of Pacific Arena.

The User is granted a non-exclusive, non-transferable right to use the Site and its content in a private context. This right consists of (i) a right to consult online data and information contained on the Site and (ii) a right of reproduction consisting of printing and/or saving consulted data and information. This right of use applies strictly for personal purposes.

All other uses of the Site by the User, notably for commercial purposes such as resale, are forbidden. The User may not for any other than personal purposes, reproduce, display, distribute, transmit, translate, adapt, circulate or communicate wholly or partially in any form any of the Site’s elements or contents.

In addition, the User may not by any means introduce any information that may modify or damage the Site’s content or presentation.

13. Severability

If any provision or part provision of the Terms are at any time found to be invalid or otherwise rendered unenforceable, that decision shall not invalidate or void the remainder of the Terms. Any invalid or unenforceable provision shall be severable so that the validity or enforceability of the remaining provisions shall not be affected

14. Termination

We reserve the right to block a User’s access to the Site immediately and without notice if, in good faith, we believe the User has failed to comply with any applicable laws or regulations or the Terms of this Site.

15. Third Party Rights

No one other than the User and us will have any right to enforce these Terms.
